New Mexico State Bilingual Advisory Committee
Bylaws
Article 1. Name
The name of the Committee shall be the New Mexico State Bilingual Advisory Committee, herein referred to as NMSBAC and is composed of 17 members appointed by the State Secretary of Education, and who are representative of the different bilingual constituencies of the State of New Mexico.
Article 2. Mission Statement
The New Mexico Bilingual Advisory Committees mission is to:
- Ensure bilingual education students and those who are becoming bilingual receive high quality academic, linguistic and cultural services in the State of New Mexico.
- Advise the Public Education Department in all areas involving the development, implementation and evaluation of the State Bilingual Education and Title III-English Language Acquisition Programs.
- Represent various Bilingual constituencies.
- Advise the Public Education Department on issues of Bilingual Education, English as a Second Language (ESL) and Heritage Language learning.
- Advise and advocate on behalf of bilingual students, their families and communities with:
o PED
o Legislature
o Educational institutions
Article 3. Organization
The members and representatives of the committee are appointed by the State Secretary of Education upon the recommendation of the committee through the director of the Bilingual Multicultural Education Bureau. The elected officers of the committee are the chair and the recorder.
Article 4. Membership
The members of the State Bilingual Advisory Committee will represent the following constituencies:
1. Instructional leaders:
a. Administrators
b. Teachers that may represent Early Childhood, elementary, middle school, high school and exceptionalities
2. Dual Language Education
3. State and national bilingual education organizations
4. Expertise in licensure and professional language assessment (Spanish and NM Native American Languages)
5. Indigenous Language communities of New Mexico
6. Indian Education Advisory Council
7. University teacher educators
8. Community organizations
9. State Director of the Bilingual Multicultural Education Bureau-Ex-officio
Membership will represent the different geographical areas of the state. Membership is voluntary and there is no remuneration for participation in the committee. Vacancies in the committee are advertised state-wide each year. Interested applicants must submit an application form provided by the Bilingual and Multicultural Education Bureau by the announced deadline. The committee will review applications and will make recommendations to the Secretary of Education who will appoint the new members. The NMPED will send a letter to the appointees and their supervisors advising them of the appointment, the schedule of meetings, and the attendance policy.
Article 5. Nominations and Election of Officers
Officers within the committee shall be elected from within the appointed membership. The election of officers will take place during the first fall meeting after August. Officers will be nominated and elected by the members of the committee. The meeting agenda must clearly announce the election of officers during the meeting. The term of office for all positions shall have a one-year term beginning and ending on the first fall meeting. Announcement of newly elected NMSBAC officers will be announced to the State Secretary of Education and to the Director of Bilingual Education immediately after the meeting when elections are held.
The chair shall preside at all meetings, appoint the chair of each standing committee, and conduct the business of the committee. The chair shall represent the committee to its members, the State Secretary of Education, the Bilingual Multicultural Education Bureau, and the public. The chair shall network and maintain communications with NMABE, NABE, and other professional affiliations. The chair shall work with the Committee to set all meetings for the year. Changes to the meeting schedule shall be announced at least two weeks in advance. An agenda for each regular committee meeting shall be sent to the committee members prior to the meeting. The chair or designee for the chair shall represent NMSBAC in all other official meetings.
The recorder shall keep the minutes of all meetings. The recorder shall submit the minutes to the chair for review and dissemination prior to the next meeting. At the end of the secretary's term, a compilation of the year's minutes will be submitted to the President and to the State Bilingual Director to be archived.
Article 6. Advisory Council
The New Mexico State Bilingual Advisory Committee is composed of seventeen voting members. To conduct Committee business, a quorum must be present. A quorum is defined as the majority of the voting membership. Members are required to attend all meetings. Members who are absent two meetings may be replaced upon review of the committee.
Article 7. Meetings
The time, number and place of the meetings shall be established in the minutes of the Committee and announced at least 30 days in advance. Committee meetings shall be held at least 4 times annually. The minutes of the previous meeting and the agenda shall be provided to those entire invited in advance. Special Meetings work sessions, committee meetings, and other meetings with no policy or fiscal decisions on the agenda do not require the specified advance notice.
Article 8. Amendments
Standing Authority
The rules contained in Standard Code of Parliamentary Procedures shall govern the Committee in all cases to which they are applicable, and in which they are not inconsistent within these Bylaws. All meetings of the Committee shall be open to the public.
Amendments to the Bylaws may be made by a majority vote at a specially called Committee meeting provided the issue to be amended is announced and the agenda clearly identifies the amendment to be considered. The amended Bylaws will be published and immediately provided to the State Director of Bilingual Education and the State Secretary of Education.
